What Factors Will a Judge Consider in a NJ Name Change Case?
Judges reviewing a request for a name change will consider the following factors:
1) Occupation of the filer.
2) Any judgments, bankruptcy or insolvency proceedings.
3) Lawsuits that may be pending in the present and desired names (in order to avoid confusion).
4) Criminal record or pending criminal charges.
5) Any previous attempt to change one’s name (and the results).
6) The stated reasons for the name change.
7) Any possible fraudulent intent.
Why Might a Person Be Denied a NJ Name Change?
1) The judge has reason to believe the name change may have fraudulent intent (e.g. avoiding creditors or criminal prosecution).
2) A paperwork or procedural error.
3) Due to the applicant’s criminal history, the judge determines it is not in the public’s interest to allow the name to be changed.
What Can I Do if My New Jersey Name Change Request is Denied?
This will depend on the reason for the denial. If the request is based on a procedural error, the Petitioner can simply file the request again with the necessary corrections. An individual who was denied due to underlying issues of fraud or criminal convictions can choose to file an appeal. If an attorney was not retained for the original filing, it is imperative to seek counsel when appealing the name change denial.
